This site is run and maintained by TradeFloor Promotions Limited and Graeme Miller Web Design (collectively known as The Companies) on behalf of Curiosity.
Use of this site is limited to individuals who must be at least 18 years old and is intended for adult Members to communicate with each other online.
We do not permit Married Members who are seeking an affair, or Members pursuing commercial purposes to use Curiosity cards, this website or any of the services provided through it. If you have been convicted of any offence (or are subject to any court order) specifically relating to assault, violence, sexual misconduct or harassment you cannot use these services.
By ticking the box next to the ‘I have read and accept the Terms and Conditions’ text on the Member Join Page, and clicking the 'Send' button, you confirm that you have read and agree to these Terms and Conditions, our Privacy Policy and that you are over 18 years of age. Every time you access this service you confirm your agreement with the Terms and Conditions.
The Terms and Conditions are personal to you. You may not assign your rights or obligations to anyone. If any provision in these Terms and Conditions is invalid or unenforceable under applicable law, such provision will be inapplicable, but the remaining provisions of this agreement will continue in full force and effect.
You agree to indemnify and hold harmless The Companies, its officers, directors, employees, agents, affiliates, partner sites and third parties, from any loss, claim or damage, including reasonable attorney's fees, arising out of or resulting from your use of this site, our Curiosity cards or any Event advertised on our web site. This includes any violation of the Terms and Conditions of this agreement or any action arising from the content that fringes the intellectual property rights (which include without limitation copyright, trade secrets, trademark or patent) of any third party or content or communication that denigrates, libels or invades the privacy of any third party.
1. Parties
These terms and conditions cover the supply of services by The Companies to you.
2. Participation
You alone are responsible for your participation in Events and any and all interaction with other Members. The Companies only provides the channel for Members to contact other Members.
The Companies do not verify the accuracy or truth of any information provided by Members. Be careful in dealing with other Members.
You may not use offensive behaviour, including (but not limited to) that which overtly sexually explicit, unlawful, threatening, libellous, abusive, harmful, bigoted, racially offensive, obscene or harassing. Further you may not encourage behaviour that may constitute a criminal offence, result in civil liability or otherwise violate any applicable local, state, national or international law or regulation.
You may not attempt to solicit communication with or on behalf of any person under the age of 18.
You may not use the services for any commercial purposes of your own or on behalf of any other person or entity.
You may not impersonate any other person or entity.
3. Harassment and disputes
You may not harass any Member. You must agree to cease contacting any other Member who has requested you to cease.
The Companies will not become involved in any domestic or private disputes between Members and does not provide any arbitration or settlement services should a dispute arise between Members.
You alone are responsible for ensuring that your interaction with other Members is lawful. The Company advises you that there may be risks of dealing with Members acting under false pretences or with criminal intent. We recommend that you read our Safety Guide.
The Companies cannot control what happens between Members once they decide to meet in person. However should you encounter behaviour that may be deemed harmful to other Members you are requested to contact the manager of the venue in which the incident occurred. If necessary, you should also contact the police immediately.
4. Member privacy
Save as set out in our privacy policy, The Company will not disclose any personal details supplied by Members that is not publicly displayed without the Member's prior written consent.
5. Service provision
This service is provided on an "as-is" basis by The Company without warranty of any kind, either express or implied, including, without limitation, warranties of title and the implied warranties of merchantability and fitness for a particular purpose.
6. Modifications to terms and conditions
The Company may modify these Terms and Conditions from time to time in its sole discretion and/or to take account of new legislation, statutory instruments, Government Regulations, Licences, similar matters and for any other reason. Any such variation shall be published on this site.
7. Legal venue
This agreement will be governed by the laws of England and the parties hereby submit to the exclusive jurisdiction of the English courts.
8. Rights of third parties
A person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any term of this Agreement but this does not affect any right or remedy of a third party which exists or is available apart from that Act.
9. Severability
If any provision in these Terms and Conditions is deemed to be invalid or unenforceable for any reason, the remaining provisions will continue in full force without being impaired or invalidated in any way.
10. Entire agreement
This agreement, which includes the privacy policy, constitutes the entire agreement between the parties pertaining to the subject matter hereof, and supersedes in their entirety any and all written or oral agreements previously existing between the parties with respect to such subject matter.
